These Terms and Conditions apply to all bookings made directly through the Sunshine N Water website for short-term holiday rentals of properties owned and managed by us. By making a booking, you agree to be bound by these terms.
1. About Us
Sunshine N Water operates short-term holiday rental properties on the Central Coast of New South Wales, Australia.
These Terms apply only to bookings made through our website. Bookings made via third-party platforms (Airbnb, Booking.com, Vrbo, etc.) are subject to the terms of those platforms.
2. Booking & Payment
– All bookings are subject to availability and confirmation.
– A booking is confirmed only when full payment (or the required deposit) has been received and you have received a written confirmation from us.
– Payment can be made via the methods offered on our website (currently PayPal and major credit/debit cards).
– Prices are quoted in Australian Dollars (AUD) and include GST where applicable.
– We reserve the right to correct any pricing errors.
3. Cancellation Policy
Our standard cancellation policy for direct bookings is as follows (unless otherwise stated at the time of booking):
– More than 30 days before arrival: Full refund minus any non-refundable fees.
– 15–30 days before arrival: 50% refund.
– Less than 15 days before arrival: No refund.
– No-shows or early departures are non-refundable.
We strongly recommend that guests take out travel insurance.
4. Check-in & Check-out
– Check-in time: from 3:00 pm
– Check-out time: by 10:00 am
– Early check-in or late check-out may be available on request and is subject to availability and additional charges.
– Access instructions will be provided after payment is confirmed.
5. Guest Responsibilities & House Rules
Guests agree to:
– Use the property only for residential holiday purposes.
– Not exceed the maximum number of guests stated in the booking.
– Keep the property clean and tidy and report any damage or maintenance issues promptly.
– Respect neighbours and keep noise to a reasonable level, especially after 10:00 pm.
– Not hold parties, events or functions without prior written permission.
– Not smoke inside the property (smoking is permitted only in designated outdoor areas if available).
– Not bring pets unless prior written approval has been given.
– Leave the property in a reasonable condition on departure (normal holiday use is expected).
Failure to comply with house rules may result in additional charges or early termination of the stay without refund.
6. Damage, Security Deposit & Bond
– A security deposit / bond may be required for some bookings. Details will be provided at the time of booking.
– The property will be inspected after departure. Any damage beyond normal wear and tear, excessive cleaning requirements, missing items, or rule breaches may be charged against the deposit or billed separately.
– Guests are responsible for the cost of repairs or replacement arising from their (or their visitors’) actions.
7. Liability
– We take reasonable care to ensure the property is safe and accurately described. However, we are not liable for any loss, injury, or damage suffered by guests or their visitors except where required by Australian Consumer Law.
– Guests use the property and any facilities (including pools, outdoor areas, etc.) at their own risk.
– We are not responsible for loss or damage to guests’ personal belongings.
8. Force Majeure
We are not liable for failure to provide the accommodation due to circumstances beyond our reasonable control (including natural disasters, government restrictions, or severe weather). In such cases we will endeavour to offer a suitable alternative or a refund at our discretion.
9. Privacy
Personal information collected during the booking process is handled in accordance with our Privacy Policy and applicable Australian privacy laws. We use this information only for managing your booking and communicating with you.
10. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
11. Changes to These Terms
We may update these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that booking.
